1. Agreement to Terms

By accessing or using the Safwat website (safwat.ae) or engaging our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services. Safwat is a registered business operating from Dubai, UAE.

2. Services

Safwat provides digital marketing, web development, design, and related consulting services. The specific scope, deliverables, timeline, and pricing for any engagement will be outlined in a separate proposal or statement of work (SOW) agreed upon by both parties before work begins.

3. Project Engagements

  • All project work is governed by the signed proposal or SOW, which supersedes these general terms where there is a conflict.
  • Project timelines are estimates unless explicitly stated as fixed deadlines. Delays caused by client feedback, content delivery, or third-party dependencies may extend timelines.
  • Payment terms are as specified in the proposal. Typical structure is 50% upfront and 50% upon completion, unless otherwise agreed.
  • All prices are in AED unless otherwise stated and are exclusive of VAT.

4. Intellectual Property

Upon full payment, the client receives ownership of all custom-designed and developed deliverables specified in the SOW. Safwat retains the right to use project work in its portfolio and marketing materials unless explicitly agreed otherwise. Third-party tools, templates, and open-source code remain subject to their respective licenses.

5. Client Responsibilities

Clients are responsible for providing timely feedback, content, brand assets, and access credentials as required by the project. Delays in client deliverables may result in timeline adjustments. Clients must ensure that all content provided to Safwat does not infringe on third-party intellectual property rights.

6. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the engagement. This includes business strategies, analytics data, customer information, and technical architecture. Confidentiality obligations survive the termination of the engagement.

7. Limitation of Liability

Safwat shall not be liable for indirect, incidental, special, or consequential damages arising from the use of our services or website. Our total liability for any claim shall not exceed the total fees paid by the client for the specific engagement giving rise to the claim.

8. Termination

Either party may terminate a project engagement with 14 days written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date. Retainer agreements may be terminated with 30 days written notice after the initial commitment period.

9. Website Use

You may use this website for lawful purposes only. You may not attempt to gain unauthorized access to any portion of the website, interfere with the website's operation, or use the content for commercial purposes without our written consent.

10. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Dubai, UAE.

11. Changes to Terms

We reserve the right to update these terms at any time. Changes will be posted on this page with an updated revision date. Continued use of our website after changes constitutes acceptance of the revised terms.
